ction 66.0.1 of the Provincial Offences Act allows a defendant, at any time, to make an application for an extension or a further extension of time for payment of a fine by completing an "Application for Extension of Time to Pay Fine" (Form 125) and filing it at the office of the court for consideration by the Clerk of the Court.
The Clerk of the Court may grant an application for extension if good faith payment efforts have been made and the application of extension is not being used to evade payment. The Region of Durham, Provincial Offences Court has outlined good faith payment criteria in the chart below in which the Clerk of the Court will consider in granting an application for extension. A good faith payment should be made prior to applying for an extension.
Upon review of an application for extension, if the Clerk of the Court is satisfied, an "Order Extending Time for Payment" (Form 126) is granted by "Order of the Clerk" with the expectation that the applicant will pay the fine in full by the due date shown on the order (including costs and victim fine surcharge). If the fine cannot be paid in full by the due date, the applicant can apply for a subsequent extension with the expection that the minimum good faith amount has been paid as shown in the green "Further Extension to Pay Fine Application" chart below.
